License Revocation Issues

A single drinking and driving offense will actually lead to two charges: one in criminal court, where you may be sentenced to jail time, fines or community service; and one in traffic court, where your license will be suspended unless you take action to prevent it.

From the moment you are charged, you have only seven days to keep your license from being suspended. Once the court has officially revoked your license, it will remain revoked for six to 12 months even if you are found innocent in criminal court. Once the suspension period is over, your license will not be automatically reinstated. You have to go to the DMV and have them reinstate it.

Even a first-offense DUI comes with enough penalties to seriously disrupt your life: You will lose your license; you may not be able to get to work; you will have to pay heavy fines; your auto insurance will go up when your license is reinstated; you will have to take classes on responsible driving.

However, if your DUI is a second or third offense, you face much stiffer penalties — higher fines, longer jail terms and longer periods of license suspension. In addition, if you have a commercial driver's license (CDL), you will lose it even if you weren't drinking and driving on the job.
